Do I have a common law marriage?

Texas uses a 3 question test to determine if a couple is common law married:

  1. Are both parties intending to be married?
  2. Have you lived together as husband and wife?
  3. Have you presented yourself to others as if you were married?

If you answered “yes” to all three questions, then you are considered common law married. If you answered “no” to any of them, then you probably aren’t.
